Important. Website material may be owned by ETHICAA, licensed or otherwise lawfully made available to ETHICAA, or owned by a third party. Rights are asserted only to the extent recognised by applicable law. This Notice does not claim ownership of third-party material or state that any name, logo or mark is registered.

This Copyright & Intellectual Property Notice (the “Notice”) applies to the corporate website on which it is published (the “Website”). The Website is operated by ETHICAA TRADING LLP (“ETHICAA”, “we”, “us” or “our”).

This Notice should be read with the Terms of Use, Website Disclaimer, Privacy Policy and Cookie Policy. It explains the status and permitted use of intellectual property displayed or made available through the Website. It does not replace a specific licence, assignment, appointment document or transaction agreement.

1. Scope and protected material

The Website may contain text, written descriptions, selection and arrangement of content, page layouts, user-interface elements, photographs, illustrations, graphics, diagrams, icons, logos, videos, downloadable documents, catalogues, product information, data compilations, databases, software code, metadata and other material (collectively, “Content”).

Content may be protected by copyright, trade mark, design, passing-off, database, confidentiality, contract and other laws. Protection applies only to the extent provided by applicable law. No right is claimed in an unprotectable idea, fact, method, public-domain material or other subject matter in which exclusive rights do not lawfully subsist.

2. Ownership and lawful-use position

Unless a different rights holder is identified, Content is owned by ETHICAA, licensed to ETHICAA, used with permission, or otherwise lawfully made available for the Website. Copyright and other rights remain with the relevant lawful rights holder in each case.

Ownership is determined by applicable law and the relevant written agreements. This Notice does not operate as, or replace, an assignment or licence between ETHICAA and a developer, designer, author, photographer, supplier, manufacturer, technology provider or other contributor.

A rights notice displayed in ETHICAA’s name applies only to rights lawfully held or exercised by ETHICAA. It does not appropriate a third party’s rights. All rights not expressly granted are reserved by their respective holders.

3. Copyright

To the extent copyright subsists, the applicable rights holder may control reproduction, storage, publication, distribution, communication to the public, adaptation, translation and other uses of the relevant Content, subject to exceptions and limitations imposed by law.

The absence of a copyright symbol or an individual attribution does not mean that Content is free to use. Conversely, the appearance of a copyright notice does not expand protection beyond the rights that applicable law recognises.

4. Limited permission to use the Website

Subject to the Terms of Use and this Notice, a visitor may access and display the Website through an ordinary web browser and may print or save a reasonable extract solely for personal reference or legitimate internal business evaluation of ETHICAA, provided that the use is lawful, non-commercial, does not misrepresent the Content, and preserves all rights and attribution notices.

This permission is limited, non-exclusive, non-transferable, non-sublicensable and revocable. It does not transfer ownership or authorise publication, external circulation, commercial exploitation or creation of a competing resource.

5. Uses requiring prior written permission

Except where applicable law expressly permits the activity and the permission cannot lawfully be restricted, prior written permission from the relevant rights holder is required to:

  • copy, reproduce, republish, upload, transmit, broadcast or publicly display Content;
  • modify, translate, adapt, abridge, combine or create a derivative work from Content;
  • sell, license, sublicense, rent, distribute or commercially exploit Content;
  • scrape, crawl, harvest, systematically download or extract Content to create or enrich a directory, database, dataset, catalogue, comparison service or competing website;
  • use Content as training, evaluation or retrieval material for a commercial machine-learning or artificial-intelligence system or dataset;
  • frame, mirror, embed or hotlink Content in a manner that presents it as part of another service;
  • remove, obscure or alter a copyright, attribution, trade mark or proprietary-rights notice; or
  • use Content, Website appearance or branding in a manner likely to imply endorsement, affiliation, authorisation or origin that does not exist.

Ordinary indexing by a general-purpose search engine is permitted only to the extent consistent with the Website’s technical instructions and applicable law.

6. Statutory exceptions and fair dealing

Nothing in this Notice is intended to prohibit fair dealing or another use that applicable law expressly permits and that cannot lawfully be restricted by contract. Whether an exception applies depends on the particular work, purpose, amount used, manner of use and other relevant circumstances.

Where acknowledgement is legally required or reasonably appropriate, the user must identify the work and rights holder accurately. A statutory exception does not authorise a false attribution, misleading endorsement, breach of confidence, circumvention of access controls or use of a trade mark in a manner that infringes separate rights.

7. Names, logos and trade marks

The ETHICAA name, logo, visual identity, trade dress, domain names and other brand elements may be protected under trade mark, passing-off, company-name, copyright, design or other applicable laws. They may be owned by, licensed to or otherwise lawfully used by the relevant rights holder.

No statement in this Notice represents that a particular mark is registered, identifies ETHICAA as the registered proprietor of a mark, or changes the ownership or status recorded in an official register or application. The absence of the symbols ™ or ® does not waive any right that otherwise exists, and those symbols should be used only where legally accurate.

No visitor may use, register or seek to register a confusingly similar name, logo, domain name, social media identifier or other designation, or use a brand element in a manner likely to cause confusion, misrepresentation, dilution or unfair advantage.

8. Third-party brands and business relationships

The Website may identify manufacturers, suppliers, principals, business partners, products or services using third-party names, logos or marks. Those rights remain with their lawful owners. Reference may be made for identification, description or to communicate the actual scope of an authorised relationship.

A third-party reference does not grant a visitor a licence and must not be used to imply sponsorship, endorsement, agency, distributorship, exclusivity or authority beyond the applicable appointment or authorisation documents. Any authorised-business-partner statement is limited to the scope, products, territory, duration and conditions of those documents.

9. Third-party and open-source components

The Website may use third-party software, libraries, fonts, icons, frameworks, hosting components or other material. Such components remain subject to their own copyright notices and licence terms. The applicable third-party licence controls that component if it conflicts with this Notice.

Nothing in this Notice narrows a permission granted directly by an open-source or other third-party licence. It also does not extend that permission to ETHICAA’s separate Content, branding, data or materials merely because they appear with or operate through the licensed component.

10. Images and AI-assisted material

Website images and graphics may be original, commissioned, licensed, obtained from copyright-free or public-domain sources, or created with artificial-intelligence assistance. They may be representative or illustrative rather than depictions of the exact goods or services available.

The use of an AI-assisted or AI-generated item does not represent that exclusive copyright necessarily subsists in every element of that item. ETHICAA asserts only those rights available under applicable law and relevant contractual terms. Underlying third-party rights, if any, are not waived or acquired by Website publication.

A visitor must not assume that an image is free to reuse because it appears on the Website or because it may have been created or modified using an automated tool.

11. Product information and documents

Product descriptions, specifications, diagrams, tables, catalogues, certificates, reports, labels and other technical or commercial documents may contain rights belonging to ETHICAA, a manufacturer, supplier, testing body, regulator or other person.

Access to such material does not authorise a visitor to alter a certificate or label, remove an attribution, market goods under another person’s material, represent an obsolete document as current, or reproduce the material for sale, promotion, regulatory submission or another transaction without the required permission.

12. Website structure, data and automated access

Rights may subsist separately in individual items and in the selection, coordination, arrangement or compilation of Website Content and data. Permitted access to individual pages does not grant permission to extract a substantial or systematically assembled part of the Website or to reproduce its overall structure, look and feel or data organisation.

Automated access must comply with the Terms of Use, applicable law, reasonable rate limits, access controls and any robots or similar technical instructions. Circumventing a technical restriction does not create permission to use the underlying Content.

13. Communications and submitted material

A person who sends text, documents, images or other material through a Website enquiry retains any rights that person lawfully holds. Submission does not transfer ownership to ETHICAA.

The sender grants ETHICAA a non-exclusive, royalty-free permission to receive, store, reproduce, review and communicate the submitted material internally and to relevant service providers solely as reasonably necessary to respond to the enquiry, assess a proposed business relationship, maintain appropriate records, protect legal rights and comply with law. Personal data is handled under the Privacy Policy.

The sender represents that the submission and the permitted handling described above do not infringe another person’s rights. Confidential, export-controlled or commercially sensitive material should not be submitted until an appropriate written confidentiality arrangement is in place.

14. Linking to the Website

A person may provide a plain-text link to a publicly accessible Website page where the link is lawful, accurate, fair and does not imply sponsorship, approval, partnership or endorsement. The Website must not be framed or presented so that its source is obscured.

We may request removal or correction of a misleading, harmful or unauthorised link. Permission to link does not authorise copying of the linked page, logo, image or other Content.

15. Permission requests

A request to use Content should identify the specific material, proposed use, format, audience, territory, duration and whether the use is commercial. We may request further information or refer the request to the relevant rights holder.

Permission is effective only if given in writing by the rights holder or a person authorised to act for that holder. Silence, previous inaction, receipt of a request or technical ability to download Content does not constitute consent. Permission may be subject to attribution, scope, quality-control, fee, revocation and other conditions.

16. Reporting suspected infringement

A rights holder or authorised representative who believes that Website Content infringes a right should send a sufficiently detailed written notice containing:

  • the complainant’s name, contact information and authority to act;
  • identification of the protected work, mark or other right;
  • the exact Website location of the material complained of;
  • a clear explanation of the alleged infringement and the requested action;
  • supporting registration, ownership, licence or authorisation information where relevant; and
  • a good-faith confirmation that the information supplied is accurate.

We may request clarification, preserve relevant records, temporarily restrict access, remove or restore material, notify the person who supplied it, or refer the matter to a service provider or adviser. Receipt of a notice is not an admission of infringement and does not guarantee a particular outcome.

A person must not knowingly submit a false, misleading or abusive complaint. The complainant remains responsible for the accuracy and legal consequences of the notice.

17. Enforcement and remedies

ETHICAA and the relevant rights holders reserve the right to investigate suspected misuse and to preserve evidence, restrict access, request removal, issue a notice, seek contractual or platform remedies, and pursue injunctions, damages, accounts, costs or other relief available under applicable law.

The availability and extent of a remedy depend on ownership, licensing, knowledge, statutory exceptions, proof and other relevant circumstances. Nothing in this Notice creates a remedy that applicable law does not provide or excludes a defence or limitation that cannot lawfully be waived.

18. No implied licence or warranty of title

Except for the limited permission expressly stated in Section 4 or a separate written licence, access to the Website grants no express or implied licence under copyright, trade mark, design, patent, confidentiality or another intellectual-property right.

The Website is made available subject to the Terms of Use and Website Disclaimer. Nothing in this Notice is a warranty that every item is protectable, that a particular person owns every asserted right, or that Website Content is suitable for a visitor’s intended use.

19. Changes and relationship with other documents

We may revise this Notice to reflect changes in Website Content, rights arrangements, technology, law or business operations. A revised Notice will be posted on the Website and apply prospectively.

The Terms of Use govern access to and use of the Website. If this Notice conflicts with the Terms of Use, the Terms of Use control Website access and use. A specific written licence, assignment or transaction agreement controls the rights and material within its scope to the extent of any conflict.

20. Governing law and jurisdiction

This Notice is governed by the laws of India. Subject to mandatory jurisdictional rules and any dispute mechanism in the Terms of Use or a separate binding agreement, the courts having jurisdiction at Hyderabad, Telangana shall have exclusive jurisdiction over disputes arising from this Notice or use of Website Content.
